Spickler Home Inspections Agreement

Home Inspection Agreement & Terms

1. Purpose of Inspection

The purpose of this inspection is to provide the Client with a professional opinion regarding the readily observable condition of the home’s major systems and components at the time of the inspection. The inspection is performed in accordance with the Illinois Home Inspector License Act and applicable Standards of Practice.  

2. Scope of Inspection

The inspection is a visual, non-invasive examination of readily accessible systems and components, including but not limited to:

  • Roofing

  • Exterior

  • Structure

  • Electrical

  • Plumbing

  • Heating

  • Cooling

  • Interior

  • Insulation and ventilation

  • Built-in appliances

The inspection is not technically exhaustive and does not constitute a guarantee, warranty, or insurance policy.

3. Limitations

The Client understands that:

  • The inspection reflects conditions observed on the inspection date only.

  • Hidden, concealed, or latent defects may exist.

  • The Inspector is not required to move furniture, personal belongings, insulation, storage items, or other obstructions.

  • The Inspector is not required to determine life expectancy of systems or components.

  • The Inspector is not responsible for future conditions, failures, or defects that become apparent after the inspection.  

4. Exclusions

Unless specifically agreed to in writing, the inspection does not include:

  • Mold

  • Radon

  • Asbestos

  • Lead paint

  • Environmental hazards

  • Water quality

  • Pest or termite inspections

  • Code compliance

  • Engineering analysis

  • Property boundary surveys

  • Underground systems

5. Inspection Report

The Client will receive a written inspection report identifying material defects observed during the inspection. The report is intended solely for the Client’s use in evaluating the property.

6. Third-Party Reliance

The inspection report is prepared exclusively for the Client named in this Agreement. No third party may rely upon the report without the written consent of Spickler Home Inspections.

7. Dispute Resolution

The Client agrees to notify Spickler Home Inspections in writing of any alleged deficiency and provide the Inspector an opportunity to re-inspect the property before repairs are performed.

Failure to provide such notice shall constitute a waiver of any claim arising from the inspection.

8. Limitation of Liability

In the event the Inspector is found liable for any loss, damage, or claim arising from the inspection or inspection report, the liability of Spickler Home Inspections shall be limited to the amount of the inspection fee paid by the Client.

The Client acknowledges that this limitation is a material term of this Agreement and that the inspection fee is based upon this limitation of liability. Similar limitation clauses are commonly used in the home inspection industry and have been recognized by courts in many jurisdictions.  

9. Time Limitation for Claims

Any claim, lawsuit, arbitration, or legal proceeding arising from this inspection shall be commenced within one (1) year of the inspection date or be forever barred. Similar contractual limitation periods are commonly used within the home inspection industry.  

10. Entire Agreement

This Agreement represents the entire understanding between the parties and supersedes all prior discussions or representations.

No modification of this Agreement shall be valid unless in writing and signed by both parties.

Client & Inspector Responsibilities

Inspector Role
  • Conduct a thorough visual inspection of all accessible major home systems.
  • Provide a comprehensive digital report with photos and clear descriptions of findings.
  • Adhere to the professional standards of practice for home inspections in IL and WI.
  • Explain complex issues in plain language to ensure informed client decisions.
Client Role
  • Book Appointment
  • Review the full inspection agreement prior to the start of the on-site visit. Payment is due before inspection begins.
  • Be present during the inspection (Not required but optional) to ask immediate questions.
  • Communicate any specific concerns or focus areas to the inspector before arrival.
